TERMS AND CONDITIONS – CASA PORCIATTI WINE & OLIVE OIL CLUB

1. Preamble and contract finalization
   By subscribing to the Casa Porciatti Wine & Olive Oil Club you accept these Terms and Conditions.
   The contract is considered finalized when the order confirmation is sent by email from Casa Porciatti Srl, based in Piazza Quattro Novembre 1, 53017 Radda in Chianti (SI), Italy.
   Shipments to the United States are handled by our logistics partner Mail Boxes Etc. (MBE) , which handles “Delivery & Customs Duties Included (US DDP)” transportation, customs clearance and delivery.

 

2. The Wine Club
   The Wine Club at Casa Porciatti is a way to receive, directly to your home, a curated selection of wines and extra virgin olive oil from Tuscany.
   You can choose from five tiers(tiers):

• Essential Italian Wine Trials
• Gravel Roads
• Sangiovese Lovers
• Great Classics
• Tuscan Extra Virgin Olive Oil

  Each tier can include 6 or 12 bottles, with 1 or 2 shipments per year, in the months of May and November.
  By subscribing to the Wine Club, you will always receive the next available shipments under the plan you choose.
  Shipments are not tied to the calendar year, but to the subscription period.
  The price listed on the website is final: it includes wine, transportation, duties and customs fees. No additional fees will be charged on delivery.

 

3. Payment
   Payment for the Wine Club is made once a year, at the time of membership, and covers all scheduled shipments for the subscription year.
   The subscription automatically renews every 12 months, unless cancelled by the customer.
   The Wine Club’s economic conditions are based on current regulations and logistics costs.
   Any future changes will be communicated in advance and may be applied only to subsequent renewals, leaving the customer the option to cancel the subscription.

 

4. Shipments and weather
   Shipments leave twice a year: in May and November.
   In case of excessive heat or cold, we may decide to postpone shipments to protect the wines.
   If you still prefer to receive them, we will, but we cannot be responsible for any damage caused by the temperatures.
   If you sign up later than one of the shipping months, you will receive the next available shipment, according to the Wine Club calendar.
   The shipping dates shown are estimated and may change for logistical or customs reasons.

 

5. Minimum age to receive wine

Casa Porciatti Srl sells and ships wine only to people who have reached the legal drinking age in their country of residence.

• In Italy and the countries of theEuropean Union, the sale is reserved for persons 18 years of age or older. By placing an order, the Customer declares that he/she is at least 18 years old.
  Casa Porciatti Srl cannot be held responsible for orders placed falsely by minors.
• In the United States, the law allows delivery of wine only to persons 21 years of age or older.
  By signing up for the Wine Club, the Customer declares that he/she is at least 21 years of age and guarantees that a person 21 years of age or older (21+) will be present at the time of delivery to sign for receipt of the package.
  Any delays or costs of redelivery due to the lack of a valid signature will not be the responsibility of Casa Porciatti Srl.

 

6. Change of Address and Redeliveries
   If you change your address, please notify us promptly.
   Any reshipment costs due to incorrect addresses or non-delivery will be borne by the customer.

 

7. Damage or loss
   If a package arrives damaged or not at all, please write to us within 7 days of delivery (or estimated date) at ecommerce@casaporciatti.it, enclosing photos and details.
   We will look into the situation and find the right solution together — a replacement or a refund, if necessary.

 

8. Subscription Cancellations and Changes
   The Customer may cancel the subscription at any time prior to the annual renewal by writing to ecommerce@casaporciatti.it.
   Cancellation stops future renewals, but does not entitle the Customer to refunds for shipments already included or scheduled for the current subscription year.

 

9. Errors and Price Updates
   If there are any errors in prices or descriptions on the site, Casa Porciatti Srl may correct them and notify you immediately.
   You will be able to accept the change or unsubscribe at no cost.

 

10. Limitation of Liability and Force Majeure
    We cannot be responsible for delays or non-delivery caused by events beyond our control, such as strikes, customs blockades, disasters or weather emergencies.
    In any case, our liability shall not exceed the amount paid for the shipment concerned.

 

11. Updates to Terms and Conditions
    Casa Porciatti Srl may change these Terms for technical or legal reasons, with notice by email.
    Changes will take effect 30 days after notification, unless otherwise specified.

 

12. Privacy and Data Protection
    Your personal data will be processed by Casa Porciatti Srl in accordance with the GDPR (EU Reg. 2016/679), only to manage the Wine Club, shipments and payments.
    Transactions are made through PayPal.
    You can always write to us at ecommerce@casaporciatti.it to consult, modify or delete your data.

13. Applicable law and competent court
    This contract is governed by Italian law.
    The Court of Siena (Italy) is competent for any dispute.
    In case of differences between the Italian and English versions, the Italian version shall prevail.
