PURCHASING CONDITIONS

DEFINITION AND SUBJECT OF THE CONTRACT
This is a distance contract within the meaning of Art. 50 et seq. Of Leg. September 6, 2005, no. 206 (“Consumer Code”). The Contract has as its object the sale of movable property between Porciatti L. & A. snc., with registered office in Radda in Chianti, P.zza 4 Novembre 1, C.F/P.IVA 00655330520, Reg. Imp. of Siena No. 00655330520, and the Client. The Contract is concluded directly through the acceptance by Porciatti L. & A. snc of a purchase proposal issued by the Customer by telephone or through the website www.casaporciatti.it and/or through other distance selling systems.

PRICES AND AVAILABILITY OF PRODUCTS
Product prices include VAT.
Some products may be subject to limited availability, therefore, Casa Porciatti’s acceptance of the purchase proposal forwarded by the Customer is subject to the in-stock availability of the products. Casa Porciatti agrees to promptly notify the Customer of any unforeseeable out-of-stocks due to excess demand or other causes.
Casa Porciatti reserves the right to waive the sale and to notify the Customer of such waiver within 10 days of receipt of the order.

DELIVERY OF PRODUCTS – COMPLAINTS
Casa Porciatti delivers the products, to the address indicated by the Customer, within 30 (thirty) days after the conclusion of the Contract.
The contract is concluded when payment is made as indicated.

Upon delivery, the customer should check:
● the integrity of the package and that it is not damaged, nor wet, that it conforms to the normal characteristics of a package.
● the correspondence of the number of packages with those indicated on the carrier’s letter.
● Signing the delivery documents implies unqualified acceptance of the goods by the customer.
● Any disputes must be immediately and raised with the carrier; failing this, the product is considered properly delivered; all documents contained in the package must be retained.
● Disputes about the package should be made first to the courier who made the delivery by calling if available a toll-free number or any other number made available, or to the nearest office. Then send by email the dispute to ecommerce@casaporciatti.it or by Fax to +390577738055 accompanied by photos, time and day of delivery, file number issued by the courier who made the delivery.
● No disputes will be accepted more than 5 days after receipt of goods.
If the goods, are visibly damaged, (broken packaging, wine spillage etc.), upon delivery by the courier, it is recommended to reject goods.
Casa Porciatti will ship the undamaged products back to you.
In case of delivery of an order of goods through several units , it is sufficient to reject only the package containing the damaged goods and write “With Reserve” on the bill.
Casa Porciatti will only replace goods that arrived damaged.

INFORMATION ON THE RIGHT OF WITHDRAWAL
The right of withdrawal may be exercised, within the prescribed time limits, by sending a written notice to the following address Porciatti L. & A. snc – 53017 Radda in Chianti (SI), Piazza IV Novembre, 1
The right of withdrawal can be exercised within 14 working days of receipt of the goods (art. 65 paragraph 2 letter a). The right of withdrawal is respected if within that time Porciatti L. & A. snc has received notice of the Customer’s intentions. Notice must be sent by registered letter with return receipt, fax (0577-738234) which is followed by confirmation by registered mail within the next 48 hours or e-mail ( ecommerce@casaporciatti.it )
Goods received must be returned to the following address: Porciatti L. & A. snc – Piazza 4 Novembre 1, 53017Radda in Chianti (SI) within a maximum period of 15 working days from the date of receipt of the goods).
Shipping costs are borne by the customer.

CUSTOMER’S OBLIGATIONS
The Customer represents and warrants: (i) to be a consumer as defined in Art. 3 of the Consumer Code; (ii) to be of legal age; (iii) that the data provided by him/her for the execution of the Contract are correct and true.
Purchase contracts entered into by minors.
Purchase can only be made by adults. However, should a purchase by a minor occur by providing false age information, or false directions to purchase the desired item and/or to access the desired data, the parents are directly responsible for payment of what was purchased without prejudice to the withdrawal discipline of these terms of sale

RIGHT OF WITHDRAWAL
The Customer has the right to withdraw from the contract entered into, without any penalty and without specifying the reason, within 10 days of receipt of the products.
The Customer may exercise the right of withdrawal, within the above-mentioned period, manifesting it by means of a written communication at the headquarters of Casa Porciatti, to be sent by registered letter with acknowledgment of receipt or by telegram or e-mail.
The Customer who intends to make use of the right of withdrawal must return the products to the address indicated on the invoice, following the instructions therein, within 15 days of receipt of the products. Pursuant to Article 55, second paragraph, of the Consumer Code, the Customer shall not have the right of withdrawal in the following cases:
– supply of tailor-made or customized products, or which, by their very nature, cannot be returned or are liable to deteriorate or alter rapidly (e.g.:, foodstuffs);
The cost of returning the products shall be borne by the Customer. Casa Porciatti will return, within 30 days from the date of receipt of the products by the Customer: (i) the full price paid by the Customer if the product is returned undamaged; or (ii) the part of the price equivalent to the product actually returned by the Customer that has worn it down appreciably and/or such as to diminish its value.
The goods must be returned in their original packaging and in suitable packaging to ensure their integrity during transport.

APPLICABLE LAW
These General Conditions, as well as any contract of sale concluded between Seller and Buyer, shall be governed by and construed in accordance with Italian law.

JURISDICTION AND COMPETENT COURT of JURISDICTION
For any and all disputes arising from these General Conditions and the contracts of sale concluded on the basis of them, the exclusive jurisdiction will be the Italian jurisdiction and competence will belong exclusively to the Court of Siena.
